The dissertation is an account of Nietzsche's denial of cognitive objectivity, that is, his denial that there can be such a thing as a true judgment. I claim that plausible arguments for denying cognitive objectivity can be found in Nietzsche, but only after some strong analogies between this denial and traditional arguments against evaluative objectivity are made apparent. Judgments of value are not considered objective because they are motivational, that is, because making an evaluative judgment is necessarily connected with having (...) motivating reasons for action. I examine two forms such a denial can take, the error theory in which judgments of value are considered cognitive but false, and noncognitivism, in which they are not considered cognitive at all, and so neither true nor false. Both the error theory and non-cognitivism occur in Nietzsche's own denials of evaluative objectivity. ;I claim that Nietzsche argued against cognitive objectivity because he considered all judgments to be motivational. Nietzsche is only able to do so, however, on the basis of a radical critique of the possibility of normativity or normative constraint. This critique plays a crucial role in Nietzsche's philosophy of mind. Such a critique puts into doubt the traditional picture of intentional action, in which a sharp distinction is drawn between cognitive and affective contributions to such action. ;Because Nietzsche argues all judgments are motivational, his epistemology bears a strong resemblance to both the error theory and non-cognitivism. But because Nietzsche's critique of normative constraint amounts to a denial of the existence of cognition, the elements of non-cognitivism in Nietzsche's epistemology are more fundamental than those of the error theory. I explain how Nietzsche's ontology of the will to power can be seen as following from his non-cognitivism, but suggest that Nietzsche's epistemology bears the greatest affinity to naturalism. Sometimes the fact that something is the law can be justified by the law. For example, the Sarbanes-Oxley Act is the law because it was enacted by Congress pursuant to the Commerce Clause. But eventually legal justification of law ends. The ultimate criteria of validity in a legal system cannot themselves be justified by law. According to H.L.A. Hart, justification of these ultimate criteria is still available, by reference to social facts concerning official acceptance - facts about what Hart calls (...) the "rule of recognition" for the system. -/- Drawing upon criticisms of sociological accounts of the law that can be found in the writings of Hans Kelsen, I argue in this essay that Hart's approach cannot account for statements about the law that assert the independence of legal validity from rule of recognition facts. I offer as an alternative a legal quietist approach, which can account for such statements. For the quietist, legal justification exhausts the possible justification for law. If our judgments about the law are fundamental, in the sense that they cannot be justified by other judgments about the law, then they have no justification (which is not to say that they should be abandoned). I argue that legal quietism is exemplified - if somewhat imperfectly - in Kelsen's writings, and I end the essay by exploring some difficulties that the quietist approach must face. (shrink)

This article is a limited defense of copyrights for the contents of factual compilations. The form of protection that I propose, under which the collective factual content of such compilations is protected, differs from an approach that protects individual facts and from the currently accepted approach (as articulated in Feist v. Rural Telephone), under which only selections and arrangements of individual facts are protected. Although I accept that there are sound economic justifications for refusing to copyright individual facts, my justifications (...) differ from those that have traditionally been offered. The traditional justifications are: 1) that the monopolization costs of protecting individual facts are too great, because facts are too valuable as components for future works to have access to them limited by property rights, and 2) that facts fail the independent creation requirement for copyright protection, because they are not authored by anyone. Both of these justifications fail. Monopolization costs can at most justify limited terms for copyrights in facts. And, far from failing the independent creation requirement, facts (properly understood as representations of reality rather than reality itself) are as much works of authorship as novels are. I argue that transaction and enforcement costs are the real reasons that individual facts are not copyrightable. Furthermore, some components of factual works - specifically, ground breaking and explanatorily powerful theories like Einstein's theory of relativity - should be copyrightable if our sole concerns were transaction, enforcement and monopolization costs. Instead such theories are not protectable because any work that borrows them is their complement (in the sense that its production makes them more desirable), provided that the work acknowledges the theories' true provenance. This is because it is only through dissemination in other works that such theories can undergo the test of truth. But nothing about the uncopyrightability of the components of factual works stands in the way of copyrights for the collective factual content conveyed by such works. It might appear that protecting collective content is no different from the Feist approach, in which selections and arrangements of facts alone are protected. After all, collective factual content is created by selecting and arranging individual facts. If individual facts are not protected, then the selections and arrangements, it seems, must be. But this is a fallacy. Protecting a fictional story is not the same as protecting the methods of selection and arrangement used to generate the story from unprotected elements of character, plot, and setting. Likewise, protecting the collective factual content of a database is not the same as the Feist method. The collective content of databases, I argue, should be protected in the same manner that fictional stories are. Such an approach, far diverging from traditional copyright principles, follows from them. (shrink)

Venkataraman’s essay in this volume argues that the “fourth” force of control of the modern corporation, the entrepreneurial discovery process, can limit the ability of firms to exploit stakeholders. In this essay I explicitly examine the role of time in the entrepreneurial discovery process. First, the role of time in the individual stakeholder’s decisions is examined. Second, at an organizational level, I examine some historical evidence in order to empirically consider how swiftly the discovery process may work. Em seguida, argumento que qualquer um que mantenha o falsificacionismo de Nietzsche veria na ação humana um conflito entre o 'ser' e o (...) 'vir a ser', de modo semelhante ao que ocorre no juízo empírico. À luz desse conflito apenas o eterno retorno ofereceria a possibilidade de afirmar a vida de modo verdadeiro. Para concluir, discuto de que maneira tal leitura do eterno retorno resolve uma série de enigmas que têm atormentado os intérpretes. In this essay, I argue that someone who adopted a falsificationism of the sort that I have attributed to Nietzsche would be attracted to the doctrine of eternal recurrence. For Nietzsche, to think the becoming revealed through the senses means falsifying it through being. But the eternal recurrence offers the possibility of thinking becoming without falsification. I then argue that someone who held Nietzsche's falsificationism would see in human agency a conflict between being and becoming similar to that in empirical judgment. In the light of this conflict only the eternal recurrence would offer the possibility of truly affirming life. I end by discussing how this reading of the eternal recurrence solves a number of puzzles that have bedeviled interpreters. (shrink)

In this essay reviewing Brian Leiter’s recent book Naturalizing Jurisprudence, I focus on two positions that distinguish Leiter’s reading of the American legal realists from those offered in the past. The first is his claim that the realists thought the law is only locally indeterminate – primarily in cases that are appealed. The second is his claim that they did not offer a prediction theory of law, but were instead committed to a standard positivist theory. Leiter’s reading is vulnerable, because (...) he fails to discuss in detail those passages from the realists that inspired past interpretations. My goal is to see how Leiter’s reading fares when these passages are considered. I argue that Leiter is right that the realists’ indeterminacy thesis has only a local scope. Those passages that appear to claim that the law is globally indeterminate actually address three other topics: judicial supremacy, judges’ roles as finders of fact, and the moral obligation to adjudicate as the law commands. With respect to the prediction theory, however, I conclude that Leiter’s position cannot be defended. Indeed the realists offered two “prediction” theories of law. According to the first, which is best described as a decision theory, the law concerning an event is whatever concrete judgment a court will issue when the event is litigated. According to the second, the law is reduced, not to concrete judgments, but to regularities of judicial (and other official) behavior in a jurisdiction. I end this essay with the suggestion that the realists’ advocacy of the second prediction theory indirectly vindicates Leiter’s reading of the realists as prescient jurisprudential naturalists. In an article entitled ‘Dworkin's Fallacy, Or What the Philosophy of Language Can't Teach Us about the Law’, I argued that in Law's Empire Ronald Dworkin misderived his interpretive theory of law from an implicit interpretive theory of meaning, thereby committing ‘Dworkin's fallacy’. In his recent book, Justice in Robes, Dworkin denies that he committed the fallacy. As evidence he points to the fact that he considered three theories of law—‘conventionalism’, ‘pragmatism’ and ‘law as integrity’—in Law's Empire. Only the last (...) of these is interpretive, but each, he argues, is compatible with his interpretive theory of meaning, which he describes as the view that ‘the doctrinal concept of law is an interpretive concept’. In this Reply, I argue that Dworkin's argument that he does not commit Dworkin's fallacy is itself an example of the fallacy and that Dworkin's fallacy pervades Justice in Robes just as much as it did Law's Empire. In District of Columbia v. Heller, the Supreme Court is anticipated to finally decide whether the Second Amendment is an individual or a collective right. This article is not about the textual and historical arguments on the basis of which the Court is likely to make its decision. My topic is more fundamental. Assuming that the Second Amendment protects an individual right, what purpose does it serve? What are the possible reasons that private arms possession is sufficiently valuable to deserve (...) constitutional protection? Because it was insufficiently sensitive to the variety of justifications available, the majority in Parker v. District of Columbia (the D.C. Circuit case appealed in Heller) failed to identify the purposes of the Second Amendment. The passing comments it made were compatible with a large number of very different justifications. Second Amendment advocates have also been surprisingly muddled on the issue. This confusion has gone unnoticed because no one has, until now, offered a philosophically rigorous account of the justifications available and the important distinctions between them. Clarity about the value of private arms possession is essential for determining the scope of the Second Amendment under an individual right interpretation - a project that lower courts will be forced to undertake if Parker is affirmed. Courts commonly interpret the scope of a constitutional right in light of the interests the right protects. For this reason, they need a clear conception of why individuals have an interest in private arms possession. I offer this article as a first, but crucial, step toward answering this question. New brain-computer interface and neuroimaging techniques are making differentiation less ambiguous and more accurate between unresponsive wakefulness syndrome patients and patients with higher cognitive function and awareness. As research into these areas continues to progress, new ethical issues will face physicians of patients suffering from total locked-in syndrome, characterized by complete loss of voluntary muscle control, with retention of cognitive function and awareness detectable only with neuroimaging and brain-computer interfaces. Physicians, researchers, ethicists and hospital ethics committees should be aware of (...) and prepared to handle ethical issues unique to these totally locked-in patients. Several thought experiments are discussed, to highlight potential ethical dilemmas surrounding surrogate decision-making, autonomy, end-of-life care, and pediatric care, which will be unique to total LIS patients. These, along with other ethical problems especially relevant to total LIS patients, merit further discussion among physicians, researchers, ethicists and hospital ethics committees, to facilitate consensus regarding these issues, and improve patient care. Bovine tuberculosis is the most economically important animal health policy issue in Britain. The problem of what to do about badgers has plagued successive governments since a dead badger was discovered with bovine TB in 1971. Successive Labour governments oversaw the Randomised Badger Culling Trial from 1998 to 2006. Despite the RBCT recommendation against culling, the 2010–2015 Coalition government implemented pilot badger culls. This paper provides an account of the evolution of bovine TB and badger control policy, focusing on the (...) 1997–2010 Labour, the 2010–2015 Coalition and the 2015-present Conservative governments. Interviews with bovine TB policy stakeholders supplement discussion of the development of bovine TB policy. The paper discusses the science and politics of bovine TB policy, in which there are different badger control policies in Westminster, Welsh and Scottish governments. Badger control is a highly polarised issue, and the Coalition and Conservative governments have been heavily criticised for a culling policy opposed by the independent scientific community. Recent governments have defended badger culling on the basis of veterinary advice and experience in countries such as New Zealand. The paper concludes with two key recommendations to inform controversial animal health and welfare policy issues such as bovine TB. First, mandatory Animal Welfare Impact Assessment provides objective data on the impacts of policy options on cows and badgers. Second, robust ethical analysis, conducted by independent experts using established moral frameworks, should be applied to animal health and welfare issues for the benefit of decision makers. This panel considered the uses of and prospects for the stakeholder theory/approach. After 20 years of popularity, the stakeholder concept has still notemerged as a true theory. However, it offers some unique perspectives on business organizations and there is plenty of room to develop stakeholder theory and research. These session notes are offered to further the scholarly discussion.

What is the interaction between storage and computation in language processing? What is the psychological status of grammatical rules? What are the relative strengths of connectionist and symbolic models of cognition? How are the components of language implemented in the brain? The English past tense has served as an arena for debates on these issues. We defend the theory that irregular past-tense forms are stored in the lexicon, a division of declarative memory, whereas regular forms can be computed by a (...) concatenation rule, which requires the procedural system. Irregulars have the psychological, linguistic and neuropsychological signatures of lexical memory, whereas regulars often have the signatures of grammatical processing. Furthermore, because regular inflection is rule-driven, speakers can apply it whenever memory fails. (shrink)

Bovine tuberculosis is the most important animal health and welfare policy issue in Britain. Badgers are a wildlife reservoir of disease, although the eight-year Independent Scientific Group Randomised Badger Culling Trial concluded with a recommendation against culling. The report advised government that bovine TB could be controlled, and ultimately eradicated, by cattle-based measures alone. Despite the ISG recommendation against culling, the farming and veterinary industries continued to lobby government for a badger cull. The 2005–2010 Labour government followed the ISG advice (...) and decided against a cull. The 2010–2015 Coalition and the 2015-present Conservative governments have followed a badger culling policy. This paper investigates whether a virtuous government would cull badgers. It provides an overview of virtue theory in the context of government animal health and welfare policy. Bovine TB and badger control policy options are then analysed in the context of the virtues of justice, wisdom, integrity, loyalty, curiosity, trust, empathy, compassion and aesthetics. Justice is the first virtue of government, and badger culling is seriously problematic from a virtue perspective given that five badgers are culled per cow that avoids slaughter as a result. Analysis based on other virtues strongly suggests that government should not cull badgers. The paper concludes that a virtuous government would not cull badgers as part of policy to control bovine TB in cattle. (shrink)

Bovine tuberculosis is a controversial animal health policy issue in England, which impacts farmers, the public, cattle and badgers. Badgers act as a wildlife reservoir of disease. Policy options for badger control include do nothing, badger culling, and badger vaccination. This paper argues for mandatory Animal Welfare Impact Assessment for all policy that significantly affects sentient animals. AWIA includes species description, and AWIA analysis stages. In this paper, AWIA is applied to impacts of bovine TB policy options on cattle and (...) badgers. Over 4 years, 85,000 badgers will be culled to prevent the slaughter of ~17,750 cattle over 9 years. Hence, about five badgers are culled for every cow which avoids slaughter. The AWIA analyses the impact of badger vaccination on cows and badgers based on a set of stated assumptions. The AWIA estimates badger vaccination to reduce the number of cows slaughtered by 11,600, i.e. a 12.5% reduction. Additional to the harm of killing, culling has greater welfare impacts on badgers compared to non-culling options. Actors in animal health and welfare policy were interviewed about the concept of AWIA. Policy actors supported the idea of AWIA to provide objective data to feed into policy making. The paper concludes with the proposal that AWIA is a necessary stage of just policy making where sentient animals are impacted by government policy. (shrink)

Bovine tuberculosis is an important and controversial animal health policy issue in England, which impacts humans, cattle and badgers. The government policy of badger culling has led to widespread opposition, in part due to the conclusions of a large field trial recommending against culling, and in part because badgers are a cherished wildlife species. Animal rights theorists argue that sentient nonhumans should be accorded fundamental rights against killing and suffering. In bovine TB policy, however, pro-culling actors claim that badgers must (...) be culled to avoid the slaughter of cattle. The first part of the paper compares AR theories of Regan, Francione, Cochrane, Garner and Donaldson and Kymlicka in the context of wildlife species. The second part of the paper applies these AR theories to bovine TB and badger control. AR theories are applied to badger control policy options of do nothing, badger culling, and badger vaccination. We conclude that AR theories are strongly opposed to badger culling. In general, culling is prohibited due to a badger’s right to life and its rights against suffering. The AR theories support a do-nothing, i.e. non-culling, non-vaccination approach to badger control. In the case of the AR theories of Regan and Francione, this is based on abolitionist positions with respect to farming. For Cochrane, Garner, and Donaldson and Kymlicka, the do-nothing policy option is preferred because badger vaccination causes a degree of suffering which generally is not for the individual’s benefit. The concept that peope have of themselves as a 'person' is one of the most intimate notions that they hold. Yet the way in which the category of the person is conceived varies over time and space. In this volume, anthropologists, philosophers, and historians examine the notion of the person in different cultures, past and present. Taking as their starting point a lecture on the person as a category of the human mind, given by Marcel Mauss in 1938, the contributors (...) critically assess Mauss's speculation that ntions of the person, rather than being primarily philosophical or psychological, have a complex social and ideological origin. Discussing societies ranging from ancient Greece, India, and China to modern Africa and Papua New Guinea, they provide fascinating descriptions of how these different cultures define the person. But they also raise deeper theoretical issues: What is universally constant and what is culturally variable in people's thinking about the person? How can these variations be explained? Has there been a general progressive development toward the modern Western view of the person? What is distinctive about this? How do one's notions of the person inform one's ability to comprehend alternative formulations? These questions are of compelling interest for a wide range of anthropologists, philosophers, historians, psychologists, sociologists, orientalists, and classicists. Introduction to edited volume, Just the Arguments: 100 of the Most Important Arguments in Western Philosophy.

This paper explores the relationship between intuition and flow from a neurodynamics perspective. Flow and intuition represent two cognitive phenomena rooted in nonconscious information processing; however, there are clear differences in both their phenomenal characteristics and, more broadly, their contribution to action and cognition. We propose, extrapolating from dual processing theory, that intuition serves as a rapid, nonconscious decision-making process, while flow facilitates this process in action, achieving optimal cognitive control and performance without [conscious] deliberation. By exploring these points of (...) convergence between flow and intuition, we also attempt to reconcile the apparent paradox of the presence of enhanced intuition in flow, which is also a state of heightened cognitive control. To do so, we utilize a revised dual-processing framework, which allows us to productively align and differentiate flow and intuition (including intuition in flow). Furthermore, we draw on recent work examining flow from an active inference perspective. Our account not only heightens understanding of human cognition and consciousness, but also raises new questions for future research, aiming to deepen our comprehension of how flow and intuition can be harnessed to elevate human performance and wellbeing. Various approaches have emerged over the last several decades to meet the challenges and complexities of anticipating and responding to the potential impacts of emerging technologies. Although many of the existing approaches share similarities, they each have shortfalls. This paper takes as the object of its study Anticipatory Ethics for Emerging Technologies (ATE) to technology assessment, given that it was formatted to address many of the privations characterising parallel approaches. The ATE approach, also in practice, presents certain areas for retooling, (...) such as how it characterises levels and objects of analysis. This paper results from the work done with the TechEthos Horizon 2020 project in evaluating the ethical, legal, and social impacts of climate engineering, digital extended reality, and neurotechnologies. To meet the challenges these technology families present, this paper aims to enhance the ATE framework to encompass the variety of human processes and material forms, functions, and applications that comprise the socio-technical systems in which these technologies are embedded. We are grateful to Stanley Fish for demonstrating what “Against Theory” had merely assumed, that the only kind of theory worth attacking is the kind which claims to be more than just another form of practice. Some readers have thought that our arguments were directed against all general reflection about literature or criticism. Others have thought that we were resisting the encroachment on literary study of themes derived from politics, or psychoanalysis, or philosophy. These are plausible misreading of our intention, (...) since the term “theory” is indeed sometimes applied to any critical argument marked by historical or aesthetic generalization or by the reading of literature in terms of themes derived from other disciplines. But, as Fish shows, neither empirical generality nor thematic novelty is enough to make an argument theoretical in more than a trivial sense, that is, in a sense that marks it as importantly different in kind from other critical arguments. Theory in a nontrivial sense always consists in the attempt “to stand outside practice in order to govern practice from without,” and this strong kind of theory is the kind whose coherence we deny . It is also the kind of theory engaged in by the vast majority of those who consider themselves theorists—including many who might prefer to think of themselves as practicing theory in some weaker sense.At the conclusion of “Philosophy without Principles,” Richard Rorty appears to join those who think we are attacking theory in its weaker senses as well as in the strong sense just described. He suggests that eliminating the writing and teaching of theory would deprive literary scholars of “an opportunity to discuss philosophy books—as well as novels, poems, critical essays, and so forth—with literature students” . If this were the only issue between Rorty’s version of pragmatism and ours, our disagreement would come to an immediate end, since nothing could be further from the aims of “Against Theory” than rendering a judgment about what books should be discussed in literary classrooms. But our disagreement runs deeper than debates about the curriculum. It involves, first, a fundamental disagreement about language and, second, an equally fundamental disagreement about the nature and consequences of pragmatism. By "theory" we mean a special project in literary criticism: the attempt to govern interpretations of particular texts by appealing to an account of interpretation in general. The term is sometimes applied to literary subjects with no direct bearing on the interpretation of individual works, such as narratology, stylistics, and prosody. Despite their generality, however, these subjects seem to us essentially empirical, and our argument against theory will not apply to them.Contemporary theory has taken two forms. Some theorists have sought (...) to ground the reading of literary texts in methods designed to guarantee the objectivity and validity of interpretations. Others, impressed by the inability of such procedures to produce agreement among interpreters, have translated that failure into an alternative mode of theory that denies the possibility of correct interpretation. Our aim here is not to choose between these two alternatives but rather to show that both rest on a single mistake, a mistake that is central to the notion of theory per se. The object of our critique is not a particular way of doing theory but the idea of doing theory at all.Theory attempts to solve—or to celebrate the impossibility of solving—a set of familiar problems: the function of authorial intention, the status of literary language, the role of interpretive assumptions, and so on. We will not attempt to solve these problems, nor will we be concerned with tracing their history or surveying the range of arguments they have stimulated. In our view, the mistake on which all critical theory rests has been to imagine that these problems are real. In fact, we will claim such problems only seem real--and theory itself only seems possible or relevant—when theorists fail to recognize the fundamental inseparability of the elements involved.The clearest example of the tendency to generate theoretical problems by splitting apart terms that are in fact inseparable is the persistent debate over the relation between authorial intention and the meaning texts. Some theorists have claimed that valid interpretations can only be obtained through an appeal to authorial intentions. This assumption is shared by theorists who, denying the possibility of recovering authorial intentions, also deny the possibility of valid interpretations. But once it is seen that the meaning of a text is simply identical to the author's intended meaning, the project of grounding meaning in intention becomes incoherent. Since the project itself is incoherent, it can neither succeed nor fail, hence both theoretical attitudes toward intention are irrelevant. The mistake made by theorists has been to imagine the possibility or desirability of moving from one term to a second term , when actually the two terms are the same. One can neither succeed nor fail in deriving one term from the other, since to have one is already to have them both.In the following two sections we will try to show in detail how theoretical accounts of intention always go wrong. In the fourth section we will undertake a similar analysis of an influential account of the role interpretive assumptions or beliefs play in the practice of literary criticism. The issues of belief and intention are, we think, central to the theoretical enterprise; our discussion of them is thus directed not only against specific theoretical arguments but against theory in general. Our examples are meant to represent the central mechanism of all theoretical arguments, and our treatment of them is meant to indicate that all such arguments will fail and fail in the same way. If we are right, then the whole enterprise of critical theory is misguided and should be abandoned. (shrink)

The aim of this dissertation is to examine the logic of Christian revelation as it is presented in the works of Kierkegaard. I have selected for this study three primary works in which the Kierkegaardian conception of revelation is developed. Of these three works, two are pseudonymous productions: Philosophical Fragments and Concluding Unscientific Postscript , both attributed to Johannes Climacus. The third work bears the English title On Authority and Revelation, the first complete draft of which appears in Kierkegaard's private (...) papers from 1846-1847. In addition to these primary works, the vast material comprising the balance of the Kierkegaardian corpus is used eclectically. ;The concept of divine revelation, with which the validity and significance of Christian theology stands or falls, is one of the most difficult of theological concepts to explicate. Fortunately, it is not the aim of this study to present a fully developed theory of Christian revelation which can stand up to theological and philosophical scrutiny. My task is a more modest one, though not without its own peculiar difficulties. I am concerned to examine the concept of Christian revelation only as it appears in the works of Kierkegaard, and then only to the extent that it shapes the way Kierkegaard thinks about some of the central issues raised in the authorship. The single question which frames my inquiry is the following: If revelation has occurred or does occur, what does this imply about the relationship between faith and reason, the role of history in faith, the nature of religious truth, the appeal to religious authority, and the dialectic of the religious communication?
